1. GENERAL RELEASE

1. I (or my above named under-aged child) have voluntarily and at our own risk elected to use the 360 Sports Park Facilities (from here on refereed to as 360SP) and equipment. I agree to hold harmless, release and discharge 360SP Co., Ltd., its owners, managers, staff and shareholders from any and all liability for injuries, claims, and/or damages, whether known or unknown, anticipated or unanticipated, even if I contend that such injuries, claims or damages are the result of negligence of 360SP Co., Ltd., or it employees.

2.RELEASE OF POTENTIAL INJURIES

2. I acknowledge and agree that the use of equipment and the participation in activities at the 360SP is inherently and obviously dangerous. These risks to myself, my child or third parties include serious physical or emotional injury, paralysis, or even death, and damage to personal property of any or all such persons. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the sports and entertainment activities which I further agree is for recreational purposes and completely voluntary. I acknowledge and agree that, while there are 360SP staff monitoring the customers activities, it is not feasible for such staff to monitor the activities and actions of all customers at all times or all customers simultaneously, and despite their training and best judgment may be not able to prevent customers from the risks indicated above.

3.VOLUNTARY ASSUMPTION OF RISK

3. I acknowledge and agree that I /or the under aged child mentioned above are participating voluntarily at our own risk. I acknowledge and agree that my own (or my child’s) actions, the actions of other customers or the actions or inactions of 360SP staff could cause me or my child significant bodily harm and injury, and that 360SP is not responsible for the actions or activities of customers using 360SP or the negligence of its employees in supervising 360SP facility or its usage, including actions, activities, or omissions that result in such harm.

4.MEDICAL AID

4. I authorize 360SP and its staff to take all steps it considers reasonably necessary to protect the customer’s welfare in the event of personal injury, including the admission of any emergency medical treatment and ambulance transportation, and agree to pay or reimburse 360SP or other involved agencies for all costs incurred in taking such steps.

5.MEDICAL CONDITIONS

5. I am of good health, free from adverse medical conditions which would prohibit me from engaging in the features offered at the park, including but not limited to disease which cause debilitated physical conditions, heart disease, asthma, or contagious disease including but not limited to influenza, conjunctivitis, hand foot and mouth disease, etc. It is the patrons responsibility to check with his/her doctor prior a visit to make sure of their fitness to engage in a particular activity. I also state and agree not to consume nor am I under the influence of any kind of alcohol, tabaco, psychotropic drugs or narcotics (legal or otherwise) while in 360SP.

6.REFUSAL OF SERVICE

6. I understand and agree that 360SP reserves the right to suspend or cancel any customers access to the park if the customer fails to comply with the park rules, staff instructions, or is engaging in indecent or illegal activities.

7.PHOTO/VIDEO/SOCIAL MEDIA WAIVER

7. I consent to image & video being taken of myself or my child for security and/or promotional purposes.

8.OTHER PREVISIONS

8. The invalidity or unenforceability of any provision of these conditions/waiver/agreement/release shall not affect the validity or enforceability of any other provision of these conditions of service/waiver/agreement/release, which remain in full force and effect.

9.TERM OF AGREEMENT

9. I understand that this agreement extends forever into the future and will have full force and legal effect each and every time I or my child visits 360 Sports Park, whether at the current location or any other 360SP location or facility.

I, the signing person, have read and understood this release form. I ( either on behalf of myself or as a legal guardian of an attending underaged child named above ) consent to and agree with all stipulated terms and conditions listed above. All my provided information is true and accurate.
